Recommended Action:

  • That Planning Report-2024-10 entitled Site-Specific Zoning By-Law Amendment – 206 Chester Road (ZBA-02-24) prepared by Ian Rawlings, Junior Planner, dated May 6, 2024 be received; and

    That By-Law 2326, being a By-Law to amend By-Law 1037, the Comprehensive Zoning By-Law for the Town of Essex, to permit the use of an existing Single Detached Dwelling to be used as a new Short Term Rental Unit (STRU) through a site-specific zoning amendment located at 206 Chester Road, be denied.

  • That Community Services Report-2024-07 entitled Special Event Notice – McGregor Music Festival, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024 be received;

    That Council approve a temporary noise exemption in accordance with Noise By-Law 2038 from 11:00 AM to 9:00 PM on Sunday June 9, 2024, at Co-An Park to accommodate the entertainment for the McGregor Music Festival; and

    That Council approve the McGregor Music Festival for Significant Event Status for the purposes of applying for their Special Occasion Permit (SOP) for their event on June 9, 2024.

RE: Special Event Notice – Colchester Walleye Derby


Recommended Action:

  • That Community Services Report-2024-08 entitled Special Event Notice – Colchester Walleye Derby, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024 be received;

    That Council approve a temporary noise exemption in accordance with Noise By-Law 2038 from 10:00 AM to 12:00 AM on June 8, 2024, at the Colchester Park to accommodate the entertainment for the Colchester Walleye Derby; and

    That Council approve the Colchester Walleye Derby for Significant Event Status for the purposes of applying for their Special Occasion Permit (SOP) for their event on June 8, 2024.

RE: Special Event Notice – Essex Fun Fest


Recommended Action:

  • That Community Services Report-2024-10 entitled Special Event Notice – Essex Fun Fest, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024, be received;

    That Council approve a temporary noise exemption under Noise By-Law 2038 from 3:00 PM to 1:00 AM on Thursday July 4, 2024, from 11:00 AM to 1:00 AM on Friday July 5, 2024, from 11:00 AM to 1:00 AM on Saturday July 6, 2024, and from 11:00AM until 6:00PM on Sunday July 7, 2024, at the Essex Centre Sports Complex to accommodate the entertainment for the Essex Fun Fest;

    That Council approve closing Talbot Street North between Victoria and Laird Avenue, Wilson Street from Talbot Street North to the entrance to the municipal parking lot, Centre Street from Talbot Street North to Alice Street North, and Gordon Street from Talbot Street North to Fox Street on Friday July 5, 2024 from 2:00pm to 8:30pm for the car show; 

    That Council approve closing Harvey Street, Albert Street, Medora Avenue, and Talbot Street between Gosfield Townline and Maidstone Avenue in Essex Centre between 10:00 AM and 11:30 AM for the Essex Fun Fest Parade;

    That Council approve the Essex Fun Fest for Significant Event Status for the purposes of applying for their Special Occasion Permit (SOP) for their event on July 4 to 7, 2024; and

    That Council permit the Essex Fun Fest to provide alcohol sales with volumes up to 473ml rather than only 355ml, which falls outside of the Municipal Alcohol Policy, and permit the sale of only four (4) drink tickets sold at one time.

RE: Special Event Notice – McGregor Mug Run


Recommended Action:

  • That Community Services Report-2024-11 entitled Special Event Notice – McGregor Mug Run, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024 be received;

    That Council approve the granting of a temporary noise exemption under Noise By-Law 2038 from 12:00 PM to 1:00 AM on September 28, 2024, at Co-An Park to accommodate the entertainment for the McGregor Mug Run; and

    That Council approve the race route starting at Co-An Park to Walker Road (North bound parking lane only), to Parnell, to the Greenway, to Concession 11 and back to Co-An Park from 2:30PM to 6:00PM; and

    That Council approve the McGregor Mug Run for Significant Event Status for the purposes of applying for their Special Occasion Permit (SOP) for their event on September 28, 2024.

RE: Special Event Notice – Harrow Fair


Recommended Action:

  • That Community Services Report-2024-12 entitled Special Event Notice – Harrow Fair, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024 be received;

    That Council approve the granting of a temporary noise exemption under Noise Control By-Law 2038 from 9:00 AM to 12:00 AM on Thursday August 29, 2024, from 9:00 AM to 12:00 AM on Friday August 30, 2024, from 9:00 AM to 12:00 AM on Saturday August 31, 2024, and from 9:00AM until 6:00PM on Sunday September 1, 2024, at the Harrow Fairgrounds to accommodate the entertainment for the Harrow Fair; and

    That Council approve closing County Road 20 from the Harrow Research and Development Centre to Victoria Street, Victoria Street South from County Road 20 to Maple Avenue, Maple Avenue from Victoria Street South to McAffee, and McAffee from County Road 20 to the Fairgrounds on Saturday August 31, 2024, between 11:00 AM and 12:30 PM for the Harrow Fair Parade.

RE: Energy Consumption and Demand Management Plan


Recommended Action:

  • That Community Services Report-2024-13 entitled, Energy Consumption and Demand Management Plan prepared by Jake Morassut, Director, Community Services dated May 6, 2024, be received; and

    That Council approve the funding of $8,344.32, to be funded through the Town of Essex Green Fund Reserve, for Local Authority Services (LAS) to provide an Energy Conservation and Demand Management Plan, which is required by July 1st, 2024, as part of O. Reg. 25/23.

RE: Community Clean-Up Initiative


Recommended Action:

  • That Community Services Report-2024-14 entitled Community Clean-Up Initiative, prepared by Jake Morassut, Director, Community Services, dated May 6, 2024, be received, and approved.

RE: Essex Tourism Events Fund Applications


Recommended Action:

  • That Economic Development Report-2024-03 entitled Essex Tourism Events Fund Applications prepared by Nelson Silveira, Economic Development Officer dated May 2, 2022, be received;

    That Council approve the distribution of $1,000.00 of funding to the McGregor Music Festival Committee from the Essex Tourism Events Fund;

    That Council approve the distribution of $2,000.00 of funding to Colchester South and Harrow Agricultural Society from the Essex Tourism Events Fund; and

    That Council approve the distribution of $1,000.00 of funding to Heritage Colchester from the Essex Tourism Events Fund.

  • That the County of Essex, Regular Meeting minutes listed in Agenda Item 12, be received.

RE: Conservation Authorities Act

RE: Fibromyalgia Awareness Day - May 12, 2024

  • That the correspondence from Fibromyalgia Association Canada asking Council to consider proclaiming Fibromyalgia Awareness Day in the Town of Essex be received or received and supported, and if supported;

    That Council proclaim May 12, 2024 as Fibromyalgia Awareness Day in the Town of Essex by adopting the following resolution:

    Whereas, Fibromyalgia Awareness Day aims to raise awareness and end the stigma and discrimination that accompany this chronic illness.

    Whereas, Fibromyalgia Association Canada is the only national organization in Canada that supports only fibromyalgia;

    Whereas, Fibromyalgia affects about 5% of Canada’s population – over 2,000,000 men, women and children of all ages and races in Canada are afflicted with this chronic illness;

    Whereas, Fibromyalgia often takes an average of three (3) to five (5) years to diagnosis;

    Whereas, there is no known cause of, prevention of, or cure of fibromyalgia;

    Whereas, Fibromyalgia (FM) is a complex illness whose symptoms vary widely and may include debilitating chronic pain, overwhelming fatigue, and cognitive impairment;

    Whereas, patients with Fibromyalgia often have a number of co-existing conditions, which may include chronic myofascial pain, irritable bowel syndrome (IBS), temporomandibular joint disorder (TMJ), environmental sensitivities, anxiety and depression;

    Whereas, Fibromyalgia (FM) greatly reduces quality of life, can cause total disability and also affect families, friends and employers. Living with chronic pain and fatigue on a daily basis can lead to social isolation, so it is important for sufferers and their families, friends, and caregivers to know that they are not alone; 

    Whereas, people with Fibromyalgia (FM) have a right to be treated with dignity and have a right to pain relief; and

    Whereas, together we will find ways to enhance the quality of lives for people affected by fibromyalgia and together find a cure.

    Therefore, I, Sherry Bondy, Mayor of the Town of Essex, on behalf of the Town Council and community at large do hereby proclaim May 12, 2024 as Fibromyalgia Awareness Day in the Town of Essex.

RE: VON Week 2024 - May 19 to May 25, 2024

  • That the correspondence from the VON Windsor-Essex asking Council to consider proclaiming VON Week 2024 in the Town of Essex be received or received and supported, and if supported;

    That Council proclaim May 19 to May 25, 2024 as VON Week in the Town of Essex by adopting the following resolution:

    Whereas, The Victorian Order of Nurses for Canada is a charitable community-based health care organization that has addressed community health and social needs for 127 years.

    Whereas, VON Windsor-Essex nurses, home support workers, community service coordinators and many other staff and volunteers have been caring for the lives and well-being of residents of the Town of Essex since 1927 and VON’s nursing, health promotion and support services make a contribution to the health care system in Ontario.

    Therefore, I, Sherry Bondy, Mayor of the Town of Essex, on behalf of the Town Council and community at large, hereby proclaim May 19 to May 25, 2024 as VON Week in Essex.

  • That the Committee Meeting minutes listed in Agenda Item 14, together with any recommendations to Council noted therein, be received, approved and adopted as circulated.

    That Administration be directed to return with a report regarding creating a voluntary list of Town of Essex residents that would like or need the Town to check on them at a time of prolonged power outages, severe weather events or disasters and whether or not the Town should provide such services.

That Council direct Administration to come back with a report discussing the inflow and infiltration to the Town’s storm and sanitary sewers, and potential solutions to help reduce flooding.  The report should speak to the ability to create an inspection program to identify and repair cross connections and sources of inflow and infiltration.
