RE: Kayoshik Road Surplus Land Report


Recommended Action:

  • That Legal and Legislative Services Report-2025-22 entitled Kayoshik Road Surplus Land Report prepared by Joe Malandruccolo, Director, Legal and Legislative Services/Clerk dated October 6, 2025, be received, and

    That By-Law 2481 being a by-law for the declaration and disposition of surplus lands (Parcel on Kayoshik Road) by the Corporation of the Town of Essex be read a third time and finally passed on October 6, 2025.

RE: 2025 Water Financial Plan


Recommended Action:

  • That Environmental Services Report-2025-03 entitled 2025 Water Financial Plan prepared by Rob Mackie, Manager, Environmental Services dated October 6, 2025, be received; and

    That Council adopt the 2025 Water Financial Plan as prepared by Watson & Associates Economists Ltd. dated August 28, 2025, as required by Ontario Regulation 453/07.

RE: 2025 Hot Mix Asphalt Program Update


Recommended Action:

  • That Capital Works and Asset Management Report-2025-21 entitled 2025 Hot Mix Asphalt Program Update by David McBeth, Manager, Capital Works and Asset Management, dated October 6, 2025, be received; and

    That Council approve additional funding up to $100,000.00 above the approved 2025 Capital Budget of $1,650,000 to complete Maple Street from Wellington Road to Erie Street South, which was a provisional road in the 2025 tender, from the Town’s Canada Community Building Fund Reserve (CCBF).

RE: Part Lot Control Exemption (PLCE) for Certain Lands within the Masaccio Drive Subdivision


Recommended Action:

  • That Planning Report-2025-19 entitled Part Lot Control Exemption (PLCE) for Certain Lands within the Masaccio Drive Subdivision prepared by Ian Rawlings, Junior Planner dated September 15, 2025, be received; and

    That By-Law 2475, Being a By-law to provide Part Lot Control Exemption (PLCE) for certain lands within Registered Plan 12M-478, be read a first, a second, and a third time and finally passed on October 6, 2025.

RE: Amendments to the Subdivision Development Agreement for the Masaccio Drive Residential Development (Ward 2)


Recommended Action:

  • That Planning Report-2025-18 entitled Amendments to the Subdivision Agreement for the Masaccio Drive Residential Development Agreement prepared by Rita Jabbour, RPP, Manager, Planning Services dated October 6, 2025 be received; and

    That By-Law Number 2483, being a By-Law to Amend By-Law Number 419, being a By-Law to enter into a Subdivision Agreement between the Corporation of the Town of Essex and Elmara Group, for the residential development known as Masaccio Drive, be read a first, a second and a third time and finally passed on October 6, 2025.

  • That the correspondence from Ontario Disability Employment Network asking Council to consider proclaiming the Month of October as National Disability Employment Awareness Month in the Town of Essex be received or received and supported; and if supported

    That Council proclaim the month of October as National Disability Employment Awareness Month in the Town of Essex by adopting the following resolution:

    Whereas, Light it Up! For NDEAM® spotlights the many ways people who have a disability contribute to businesses and their communities, demonstrating how disability inclusion in employment can drive success and competitiveness; and

    Whereas, Light it Up! For NDEAM® is the main event of Ontario Disability Employment Network (“ODEN”) and is a national movement celebrating its fifth anniversary with a one-night coordinated special lighting event which occurs on the third Thursday of every October; and

    Whereas, in 2024, over 800 locations in almost 200 communities across Canada illuminated in purple and blue. This nationwide collaboration involves ODEN, the Canadian Association for Supported Employment, MentorAbility Canada, the federal government, municipal and provincial governments, Jobs Ability Canada, and many community-based agencies. It is this collective effort that makes "Light It Up! For NDEAM®" a powerful event in big cities, small towns, and rural communities from coast to coast; and

    Whereas, the Town of Essex encourages local business and community members to participate by illuminating key landmarks in purple and blue.

    Therefore, I, Sherry Bondy, Mayor of the Town of Essex, do hereby proclaim the month of October as National Disability Employment Awareness Month and invite businesses to participate in the national event to further celebrate workplace accomplishments of people with disabilities across Essex County on October 16, 2025 for Light it Up! For NDEAM Day.

  • That the Committee Meeting minutes listed in Agenda Item 14, together with any recommendations to Council noted therein, be received, approved and adopted as circulated.

    That Council direct Administration to revise Closed Meeting Agendas of Council to provide as much information as possible about the general nature of the matters to be considered in Council's resolutions to go into a closed meeting, without compromising the reason for holding a closed meeting, with such revisions being implemented for all Closed Meeting Agendas published by the Town going forward after the passing of this resolution.

    Whereas the Town of Essex Zoning By-Law currently provides parking exceptions and exemptions for existing buildings located on lands in Parking Exception Areas in downtown Essex and downtown Harrow, for example waiving parking requirements for retail establishments; and

    Whereas opportunities to construct new developments on vacant lands in Parking Exception Areas in downtown Essex and downtown Harrow are available for infill development; and

    Whereas a goal in the Town’s Strategic Plan is to leverage our Town’s competitive advantages to promote jobs and economic investment.

    Now Therefore be it resolved that Council direct Administration to initiate the Zoning By-Law Amendment Process to consider parking exceptions and exemptions for new commercial construction in Parking Exception Areas in downtown Essex and downtown Harrow.

    Whereas the Town of Essex supports residential intensification as a means to help make Essex more affordable and provide more housing options for its residents; and

    Whereas the main mode of commuting for the employed labour force in private households in the Town of Essex is a motorized vehicle.

    Now Therefore be it resolved that Council direct administration to report back to Council on parking requirements for residential uses, considering such factors as unit size, building type, location, and density, and include issues and opportunities with the Town’s current parking requirements in its Zoning By-Law.

That Council direct Administration to provide a report detailing the state of Municipal Drains bounded by County Road 50 from Erie Road to County Road 41 in the Town of Essex and that such report include the number of drains, capacity of drains, and whether or not Council has any ability to implement drainage works without a petition from residents.
