This meeting was hosted and chaired from the Essex Municipal Building. Due to the ongoing COVID-19 pandemic this meeting was not currently open to the public for in person attendance. This meeting can only be viewed by the public electronically via livestream on YouTube at www.youtube.com/EssexOntario

This statutory public meeting was being held for the purpose of providing background and public information in regards to a proposed site specific zoning amendment at 96 County Road 50 West, Colchester South, Ward 3.


Mayor Snively called the meeting to order at approximately 4:30 PM.

There were no conflicts of interest noted at this time.

RE: Site Specific Zoning Amendment for the Vacant Lands located at 96 County Road 50 West

Lori Chadwick, Director, Development Services advised that the purpose of this meeting was to hear from the public in regards to the merits and concerns related to the application for a site specific rezoning application on the property located at 96 County Road 50 West. Ms. Chadwick explained that the Colchester Secondary Plan establishes a cohesive vision and planning framework for the area for balanced and sustainable future growth. This property is a vacant municipal-owned land currently used for overflow parking and provides access to municipal water, sanitary, and storm sewers along County Road 50 and Dunn Road.

Ms. Chadwick stated that the rezoning application is to permit a two-story motel with twenty-eight guestrooms and noted that the zoning will remain R3.1 with the Motel as an additional permitted land use. The operators are the proprietors of the Grove Hotel in Kingsville and future plans for the motel include on-site parking, a café, and indoor bicycle storage facilities.

Ms. Chadwick noted concerns from residents such as increases in traffic, lack of public parking, loss of green space, loss of residential opportunity, strain on municipal infrastructure, loss of lake views, noise generation, and architectural style. She explained that studies were submitted for the photometric plan, landscaping plan, stormwater management, functional servicing report, and traffic memorandum. Ms. Chadwick also mentioned that this plan had been circulated to ERCA, Essex Fire and Rescue Services, Enbridge Gas, and the Essex Accessibility Advisory Committee with no objections.

Ms. Chadwick stated that the Zoning By-Law Amendment will be prepared for Council's consideration at the June 21, 2021 Regular Meeting and directed questions from Council.

Councillor Garon asked how many parking spaces will be removed.

Doug Sweet, Director, Community Services/Deputy CAO, stated that currently there are 9 municipal parking lots with 333 parking spaces within the parking lots. Mr. Sweet advised that the removal of this lot will result in 297 parking spaces with 275 spaces being open to the public.

Councillor Vander Doelen asked if any of the trees from the property could be transplanted to another area.

Ms. Chadwick noted that many trees could be saved depending on the life span and the condition of the tree.

Deputy Mayor Meloche asked how many regular events take place that require all the parking spaces.

Mr. Sweet stated that based on the past few years there has been the Annual Fishing Derby, Colchester Family Fun Day and some smaller events such as Monday night concerts.

Deputy Mayor Meloche asked if we would be able to continue to use the parking lot on County Road 50 next to this property.

Mr. Sweet stated the property that Deputy Mayor Meloche is referring to continues to be used as additional parking for the Town.

Mayor Snively noted that many people attend the fishing derby but there are shuttles.

Janice and Chris Smith, Residents of Colchester, expressed concerns regarding the location of the motel and explained how the potential for decreased property values, increased traffic, noise, and lack of parking may impact residents.

Mayor Snively stated that these concerns will be considered and addressed with the developer.

Councillor Bjorkman explained that 28 rooms will not have a drastic effect on traffic. He noted that any kind of change that is not typical to an area can raise concerns regarding the possibility of decreasing property values but felt this development would not result in decreased property values.

Mr. Smith asked if alcohol would be served on the property.

The Chair called upon Kim Lewis, Owner, Grove Hotel, who was virtually in attendance to answer questions from Council and residents.

Mr. Lewis stated that they do not intend on serving alcohol at this location.

Councillor Bondy stated that residents should email Council their concerns regarding this development no later than June 21, 2021. She explained that she would like to connect with the Colchester community to see if this development is what Council and residents of Colchester want. Ms. Bondy also noted that she believes the developers will accommodate the community as much as possible and inquired whether the proceeds from the sale could be reserved for further acquisition of land for parking.

Deputy Mayor Meloche explained that the property was intended for controlled commercial development and believes that this development will help accommodate the local wineries.

Councillor Verbeek asked if a six-story apartment building could be built on this piece of property without any amendments to the zoning by-law.

Ms. Chadwick stated that a 5-6 story building with 50-70 residential units is permitted by right but would require a site-plan control which would be similar to this application. She noted that the zoning for this property is high residential density zoning.

Kelly Bedal, Resident of Colchester, addressed concerns with increased traffic and parking. Ms. Bedal stated that the public parking spaces currently available are often reserved for the community center and boats. Ms. Bedal inquired whether there was an update to the recommendations regarding stormwater and the quantity of water. She also inquired whether this amendment would allow for the proprieties to build an additional floor in the future.

Brad Allard, Resident of Colchester, asked if a study was conducted for residual tanks and whether the motel would permit patrons to reside there full time.

Lori Chadwick, Director, Development Services, explained that Council will receive the report and agreement at the June 21, 2021 Regular Council Meeting. She further explained that the application is for 2 stories and language will be included in the rezoning amendment to prevent future growth. Ms. Chadwick also explained that Administration is working with applicants to perform environmental site assessments, soil sampling, and ground penetrating radar. Ms. Chadwick stated that the motel only allows for accommodation for 28 days or less and that the site plan review process includes land use, number of parking spaces, and radius.

Mr. Allard inquired where patrons to the café would park.

Lori Chadwick stated that the application review examined the number of parking spaces, radius of movement as well as width of parking aisles and the site plan exceeded the parking requirements for the land use.
